REASONS WHY THE CONSTITUTIONAL CHALLENGE TO CHILD >SUPPORT IS OCCURRING IN
CALIFORNIA
1.) For too long Father's have suffered in silence, and as the Declaration of
Independence warns us: 'While >evil's are sufferable' it has become a fact
that the modern feminist run Child Support system here in California has gone
completely out-of-control with zero accountability and has exceeded the terms of
oppression and enslavement specifically against fathers in this state.
a.) If fathers are handicapped, debilitated, almost killed in car or
motorcycle accidents; if they lose their job; or have back injuries which
cripple them: they must pay child support regardless.
b.) If fathers have their children criminally stolen from them by the
mother the state will back the mother and force the father to pay child
support, regardless.
c.) HOWEVER: any father committing the same identical acts and taking their
children from the mother, conversely they are imprisoned!!!!! (The mother is
virtually never imprisoned, and any charges filed against her in court, or
with police or the Sheriff office, are illegally ignored by the DA and
courts).
d.) If a father through no fault of his own, loses his job, or has any
other change of fortune; he must pay child support regardless.
2.) If any father mandates their children, and makes any claims to raise them
on his own, against the state, with no cost to the taxpayer, then the children
are taken from him and he is forced to pay for child support regardless, and the
child support courts go after him with a vengeance to put him in his
place.
3.) Any father demanding to keep his child off of welfare is overtly attacked
by the present system and he is forced to pay child support regardless. He is
then labeled an 'abuser.'
4.) Any supplication for 'Motion for Modification' are usually ignored in
court, and usually, a father cannot even pay to enter these courts to file the
motion which is 'discretionary' to the court.
5.) Men who are in jail through no fault of their own, are still forced to
pay, and the child support bill rises even while they are in jail as they are
expected to pay for child support regardless of their circumstances, even when
they cannot! (This is the greatest part of the governments advertised figures of
nonsupport: those who are in prison, and those who are dead).
6.) The present system is controlled and owned by a radical hate group called
feminists: whom have overtly and publicly lied and used direct deceit against
fathers, and held these false facts out to the media and public in which to gain
support in government to enslave fatherhood. (Lawyers are also part of this
problem, and do not directly defend Father's Rights.)
a.) There are no 'Father's Rights' employees within the 'Child Support'
system or the Department of Health and Human Services within California.
b.) There are no 'Constitutionalists' employees within the 'Child Support'
system or the Department of Health and Human Services within California.
(There are communists, socialists and feminists however.)
7.) These feminists who are embedded within the courts and the Health and
Human Services and government communities are:
a.) Overtly applying social engineering against fathers and families in
which to separate them at any costs. (Hillary Clinton's 'Village')
b.) Specifically attacking fathers as a group-which they have great enmity
for.
8.) It is so bad, that those within government actually 'think' that they:
'government', own our children, and that parents and especially fathers do not.
(And they are now controlling our society through our children).
9.) A father has zero: absolutely no rights to his own children under the
present system. His only right is to be attacked and financially burdened. (If
he gets 'visitation' the courts do not enforce that). Any other supposed
'rights' are only a fraud.
10.) The other sides only response to this crisis is outrageous; they claim:
'If he can't pay for the child then he shouldn't have had sex in the first
place.' As if fathers didn't have human rights. (This is never said against the
woman!)
11.) Men are constantly harassed and imprisoned by this system, which
fulminates its own problems and drives men into debt and even suicide and
murder. At no time will it allow the father to obtain his own solution and
handle his own problems.
12.) D.A.'s and courts are bought-off through Federal and State Title IV-D
Federal funding and are instruments of feminist brutality:
a.) Men are arrested without any due process or remedy at law, and
'warehoused' into prison for profit.
b.) If they cannot pay, then, their friends and families must pay the
extortion to get him out of jail. (These are in fact, modern day debtors
prisons.)
c.) If the family or Father cannot pay the extortion, then, the public must
pay the extortion through paying for the fathers warehousing in the state or
county debtor's prison.
d.) There is no lawful excuse in the courts for not paying child support.
Courts only enforce imprisonment, or direct coercion to pay exorbitant amounts
invented by District Attorneys. Fathers whom claim disability, or any other
legal reason on earth, are only ignored.
13.) Directly due to this system, children are doing far worse than they ever
have before in our society. However; those within the government and courts want
this because these social pathologies that they themselves are creating and
managing add to their empire and bring them more power and government funding.
Fatherlessness is the #1 problem in this nation with approximately 40% of this
nations children going to bed every night without their own father in the home.
No society throughout human history has had to deal with the impacts of such an
overt war against fathers. IT IS A FACT, THAT THE CONDITION OF THE CHILDREN
FOLLOW THAT OF THE FATHER 'IF' THE FATHER DOES WELL, SO WILL THE CHILDREN! Since
fatherhood is not doing well in this state and in our nation, it is a direct
corollary, that neither are children and the facts bear this Maxim of Law out.
If people are serious about helping children, it is about time they recognized
the fact that they better start helping out their fathers.
14.) If fathers defend themselves in court, then their paperwork is ignored,
and no time is any redress of grievance allowed them, and at all times they are
hunted and forced to be imprisoned. The system is a complete fraud which is only
there to instantly seize his wealth, then upon any failure of that father to pay
further extortion, to immediately place him into jeopardy of constant double
jeopardy violations of imprisonment, wage garnishments, or drivers license
seizures, etc, etc.
15.) The media has supported this system and has held Father's Rights to a
virtual news blackout.
16.) Fatherlessness is now proactively taught in the schools which now teach
gay and lesbian lifestyles; tolerance; women's rights, and other anti-male,
anti-family issues as 'normal' and as 'rights'.
17.) It is a fact, that children are coming home from these schools, telling
parents that they can no longer spank them, that they cannot yell at them or do
any 'discipline' against them and now, parents live in silent fear of government
and its power against their own children whom they are afraid to punish and/or
regulate, for fear that any such reasonable acts will bring 'jack booted' thugs
to their door to seize their children, to arrest them, and then to seize their
property.
18.) The present system compels a father and forces him to pay for, and to
fund his own destruction. It willfully enslaves him and directly disenfranchises
him, and holds him into slavery over his own property (his own children).
19.) No other 'crime' has as many penalties, or is more rigidly enforced than
'Failure to Pay' child support. Murderers themselves do not get civilly murdered
the way fathers do. No crime carries as many penalties: it is a fact, that
murderers and Anti-American terrorists are able to drive, to have bank accounts,
to obtain pilots licenses, they can fish and hunt, they can obtain professional
licenses to obtain employment, they never get their wages garnished; however,
all of these things are denied to all fathers in this nation who are directly
hunted with a vengeance never seen before in human history.
20.) These perversions against fathers are an affront to our free form of
government and have created a soviet gulag prison system to which now California
and America leads every nation on earth, including all other communist,
totalitarian and terrorist regimes on earth with the largest prison populations
ever seen before in human history, directly due to the outright attack against
fathers and men merely having children!
21.) It is a fact, that this 'Child Support' system has invented and
manufactured more fathers into criminals by a mere stroke of the pen. Fathers
are forced into debtor's prison by the DA's merely writing down amounts that
they owe tens or hundreds of thousands of dollars. What they could never accrue
or borrow in wealth, they now owe by mere corrupt design by government by the
mere stroke of a pen! They fully understand that men cannot pay these fantastic
amounts, and regardless of that fact, then place them and warehouse these men
into debtors prisons and then turn and force the taxpayer to pay these inhumane
amounts of extortion by warehousing the father into debtor's prison and forcing
the taxpayer to subsidize that incarceration!
22.) Any mere allegation of 'abuse' now has court systems placing 10 innocent
fathers in jail to 'get' the one father that 'may' have abused his wife or
child. Now any mere allegation places men in jail in organized witch hunts which
has factually placed more innocent men into prison than any time in human
history. Mere strangers can pick up the phone and 'allege' abuse and have men
arrested or have children forcibly stolen from homes and families, with no
redress or remedy at law for either families and/or men.
23.) It is a fact, that the state, along with its surrogate courts are
fulminating hopelessness and attempting to exacerbate violence so that they may
profit from that mixed war they are effecting on normal citizens (most whom have
never had any problem with legal issues before, and in fact, most of whom are
veterans, who served their country with honor and distinction, but now are
outright hunted and disenfranchised within their own homes!!!) Clearly, there is
a larger design to all of this, which appears to dovetail directly into changing
our form of 'free government' into 'something else' by overthrowing our society
from within.
24.) It is a fact, that this system is in reality Marxist Jurisprudence.
Where the communists used 'class' in order to control the means of production,
the feminists, government and courts now use 'gender' (males) in order to
control the means of production. It is clear, that this is merely a transfer of
wealth program, dedicated to transferring wealth from men into government and
females.
WHEREAS, directly due to these reasons, and attacks and outright perfidy
committed against us as a Domestic Violence against us within the State of
California courts and all government officers within the Health and Human
Services 'Child Support Enforcement' cabal; we are forced to bring this issue to
a constitutional challenge within the Courts of California themselves for lawful
adjudication and redress. We do not find comfort in this, as we feel that all
the courts within California have collapsed, and are acting capriciously and
illegally in direct contravention to the law. That they do in fact, have a
mandate to deny and frustrate any just redress of grievance on this issue.
We have supplicated redress from Barbara Boxer, Diane Feinstein, Governor
Grey Davis, and virtually all our legislators, throughout the complete aegis of
the three branches of government who have been informed of these problems, and
they have remained deathly silent towards us.
It has become a fact of life, that fathers are hated by government, and
fathers must support this hatred financially, and receive no rights for their
compelled financial support. (Slavery). This has simply come down to a financial
monetary issue. Government now has become a public menace against fatherhood. It
now entices females through government founding's, and other 'victim' related
programs to move away from the father, who instantly has no enforceable rights
within the courts. There can be no arguments as to these facts, as the proof of
debtors prisons continually filling with fathers (and not mothers) along with a
steady stream of Federal funding into the State and Counties prove beyond a
shadow of a doubt that this is a growth industry dedicated against fatherhood,
families and children.
Counties now plan their budgets around this funding, and their courts are
presently bought off through that funding to ignore their most basic laws that
simply under Article I, Section 1 of the Constitution of California ''All men
are by nature free and independent, and have certain inalienable rights, among
which are those of enjoying and defending life and liberty; acquiring,
possession and protecting property; and pursuing and obtaining safety and
happiness.' Article I, Section 1; Constitution of California (1849) [Adopted by
the Convention, October 10, 1849; Ratified by the people, November 13, 1849;
Proclaimed, December 20, 1849.]
This Constitutional Challenge to the Child Support Industry will factually
decide whether we are to be a government bought off through federal funding; or
a constitutional government whose public servants are compelled by law to uphold
the rights of all citizens. The present system has only been wrought with
compelling failure, as that failure we believe has been planned. This is an
egregious oppression against fathers and men whom it has factually
disenfranchised for profit. We are sick and tired of being slaves in our own
country and will no longer tolerate this insolence from our own 'public
servants.' The idea of civil murder in a free society is opprobrious to our form
of government and must be stopped. 'IF' fatherhood is to be labeled into a
modern day crime, then, we will insist in only one penalty for that crime, and
not civil death, (Ergo: Loss of license, drivers license, wage garnishments,
professional licenses, continual double jeopardy imprisonment, etc.).
THEREFORE, this Constitutional Challenge is now going into the courts as a
last resort, from the SUPERIOR COURT OF SAN FRANCISCO to the UNITED STATES
SUPREME COURT if necessary, and we are demanding it be heard, and that WE
FATHERS be heard. As this present slave based, debtors prison fraud has become
intolerable, and we will neither support this fraud anymore, nor financially
back it through having our own children held hostage to us for profit. If these
courts fail us in our supplications for justice and redress of grievances, then
we will be forced to seek out criminal indictments against ALL those within
government committing these acts of terrorism and Domestic Violence against us,
and defend ourselves by any means necessary.
We must have redress in this issue, and are lawfully seeking it within the
courts which must hear these issues and provide us with remedy and protections
at law. We are not the enemy. We never were. The idea that this problem has
exacerbated to this point means that there is a profound sickness within those
within the courts and government whom have pro-actively fulminated this issue
for their own ulterior purposes and designs. We must not only stop this perfidy,
but we must also study how it happened, so it may never happen to any other
citizen or group in our country again.
