Dear Senator Specter:

I recently read with great interest the website of the PENNSYLVANIA CHAPTER FOR CHILDREN’S JUSTICE, particularly the allegations of legal impropriety, bias, and outright repression of any dissent by the family court judiciary in the commonwealth. This was of particular interest to me, since I am a both father paying child support into the chester county court system, a system that routinely abuses fathers’ rights, and a law student.

Unreasoned authority, as I am certain you agree, devolves to mere authoritarianism. But in many of the commonwealth’s courts, this is the deplorable situation. In my case, I recently discovered that my former spouse actually had the gall to write to family court administration, complaining that she was no longer able to afford an attorney, because she had already directly endorsed over thousands of dollars in child support funds to her attorney, to pay for representation in a custody dispute. This same attorney, I might add, currently sits as a mediator in child custody disputes in the same jurisdiction.

The inherent conflict of that sort of appointment really boggles the mind. But, in this jurisdiction, among the most political in the state, infamous for these sorts of arrangements, it is par for the course. The courthouse is rife with political cronyism, and everyone knows it.

The allegations of judicial misconduct in Lehigh County, therefore, are disturbing. From my experience, I give them complete credence. I therefore urge you to withdraw your nomination of Judge Gardner to the 3rd Circuit Court of Appeals, until he gets his Family Court in order.
