Dear Webmaster, My question concerns how daycare costs are handled. My husband's ex decided to send their son to a summer camp program to be cared for while she worked. She demanded 50% of the cost. My husband works third shift. He works third in order to be able to care for out three children while I work. This is a huge sacrifice, but we can't afford daycare. Because he is available to watch his son, he told his ex that he would care for him instead of sending him to camp. This would save both of them money, and it would be in the best interest of the child. She decided she would rather not have his father care for, and signed him up and took him to camp instead. Now she is demanding 50% of the costs, and threatening to have it taken from his pay if he doesn't pay within 3 weeks. Can she do this even though one parent was available to care for the child? If the courts will allow this, yes she can, it was done to me. My ex claimed daycare expenses when I was available. The courts would rather have the child in daycare so that they can take more money from your husband in the name of "child support collected" IT MAKES THEM MONEY FROM THE FEDERAL GOVERNMENT. Another question I can't seem to find answers on. Does the Child Tax Credit and Child Care Tax Credit come in to play when daycare costs are involved? Isn't half of the tax credits that the mother gets allowed to be deducted from what the father is required to pay? Your husband PAYS and the ex gets to claim it on HER
taxes. YEP....that is how it works. |
