I am totally frustrated with the department
of Domestic Relations and the family court system in Beaver County. For
the past 3.5 years both of these institutions have ignored and refused to
abide by the State laws for determining spousal support. My
wife blatantly lied about her income and expenses when she filed for
support after I filed for divorce. I presented proof to Domestic
Relations and the Court of Common Pleas which clearly shows that she has
hidden nearly $300,000.00 in cash in mutual funds, was receiving
$300.00 a month in rent on top of $433.00 a month from Social Security
disability, transferred more than $1,000,000.00 of property assets out of her
name and into her daughters, and [they] ignore me like I don't exist. Neither
department will request, nor grant my request for her financial records
so that her income can be accurately determined. The court not
only continues to give her 40% of may, but they recently gave her an
increase despite my objections and demands for an accurate accounting and
determination of her income. I've showed her real and
potential income to be nearly $5,000 a month which is more than
three times what I earn and [they] still refuse to consider the
evidence.
I don't know what to do. Her attorney has
(and I have proof) perjured himself on six separate occasions in court regarding
the whereabouts of this money and despite my insistence for an
independent accountant be appointed to accurately determine her financial
status the court ignores me. When I brought up the subject of this
money during the last exceptions hearing in front of judge Kwidis he said
he was only going to consider my income and not hers. He said her income
didn't matter, only mine. Correct me if I am wrong, but that is not
what the law says. By the way, my wife's attorney is engaged to be
married to her daughter. ALL of these assets that he has moved will end
up in his name after the marriage.
One of the last thing I did was to petition
Domestic Relations for a new hearing (not a modification). A few weeks
later I received notice that a hearing was scheduled. I then
wrote and asked Domestic Relations to formally request my
wife's bank records for examination at that hearing. On the
day of the hearing, I no sooner sat down when the officer says the
hearing was scheduled in error and my case is dismissed. I was boiling
mad! I filed exceptions and a hearing has been scheduled before judge
Kwidis for January 18th at 9 AM. He is going to dismiss my case [again].
Will some one please tell me what the chain
of command is? Who is responsible for making sure these seemingly
untouchable government agencies and higher than mighty judges abide
by the laws of this State? During a not so long ago consultation I had
with an attorney, I voiced my frustration with how DR and the court ignores the
laws and makes decisions upon how they feel at the time. The attorney
looked me right in the eye and said..."You've lived in this county
for how long? You should know by now that the judges in Beaver County
don't abide by the law, they make it!"
My personal opinion is that we need video in
the courtroom. If you put these judges on camera, they are less likely
make decisions outside the laws of the State. In two of the
transcripts I reviewed, I noticed very pertinent information was omitted.
I don't believe in coincidences or accidents. A video would have
prevented this. Judges and officers like those of the Domestic Relations
department should be held liable for violating the law. Either way
something has to be done to make sure the courts, themselves, start
obeying the laws.
I have a cousin who had 13 law firms and
spent about $31,000.00 before he got his divorce. His case was a dozen
times worse than mine....and Kwidis was his attorney at the time. His
former father-in-law is so powerful in this county, he bought off that many
firms with gold bars.
You want stories? You'll find plenty in
Beaver County. Beaver County is one of the most corrupt systems in the
State. I've already written and complained to the Supreme Court and to
date not a thing has been done. I intend to contact Judicial Watch
to see if They will provide any help. Some one has to do something about
these judges and government services like Domestic Relations. They do
what they want regardless of the law and outside of you, no one seems to want
to do anything to correct the problem.
