Dear Sir: I am located at McKean County (northwest of PA). For the past almost 2 years, I have been involved in the legal system with custody and divorce case. My estranged wife had made false allegation to the domestic violence center which had me evicted from our home without any investigation. A week later, I was served to appear to the family court for supports. Two week later without seeing my 3 children, I appeared in the court to contest it and came out of the court with CPS investigation on me for molestation on my oldest boy (at the time 6 years old) that granted her one year temporary full custody with supervision (my mother was the supervisor which was against my estranged wife's approval) and no overnight visitation. The CPS did the investigation and it ended up UNFOUNDED. My attorney brought back this to her attorney and my estranged wife refused to allows me to have my children unsupervised and overnight. My attorney filed for the custody for me and was well aware of her frauding the legal system. It had taken almost a year before I finally gained the custody (shared) of my children. Because the court did not punished her for her unwilling to be reasonable and contempt the court orders, I am back to the court again with her fraud. This was done at all my expenses not her. She had quit her self-employed job before this so I would have to pay 100% support to her out of my paycheck. Because I refused to lose my children and her abusing the legal system, I had to borrowed my 401K loan. I pleaded my attorney to put an restrained on my estranged wife for selling my personal and community properties while I was restrained to stay away from my home. My attorney told me that as long as we are still married, there is nothing he could do unless I filed for divorce. Per the court appointed psychologist and my attorney, they convinced me that there is no hope for reconciliation so I filed for divorce. The court appointed psychologist did do the evaluation on us with the children and recommended that I should have the primary custody due to her mental and physical illness. The judge ignored that because I am employed and the breadwinner which she not. Fear of losing my children, I agreed on shared custody instead of full custody which he granted 3 weekend out of 4, equal times on my boys school vacation, and 4 weeks in the summer. The divorce was not finalized because the unfair and unconstitutional settlement. Since that, my estranged wife continue being unreasonable and more vindictive like PAS (parental alienate syndrome). I am currently being petitions again and my attorney knows I don't have money so no longer want to represent me and realized this has been his worse case he had been involved in his 23 years of law. I would appreciate it if you can advise me what I can do. I was told that the McKean County had been biased and destroyed many fathers because we don't have an attorney who know the current laws and not afraid to speak up to Judge Clelend. I do need a legal advise to protect myself and the children. Thank you for reading my letter. |
