David Kearns November12, 2003 Dear Congressman Shuster, I am in receipt of your letter dated October 21, 2003. Admittedly, I am dumbfounded at the apathetic response you offered. Let me clear up some things that you may have misinterpreted. First off I am well versed on the Constitution and realize that it establishes the separation of powers between the three branches of government. However, my letter at no time requested for you to use your authority to interfere or involve yourself with the “legitimate” duties of the Judicial Branch of government at any level. As I have indicated my brother’s custody case was riddled with criminal activity perpetrated by Blair County Judge Hiram A. Carpenter. The most egregious of those “crimes” was tampering with public records and altering hearing transcripts to fabricate evidence. This degree of judicial misconduct does not fall under the legitimate duties of the judicial system or for that matter any government entity. Secondly, at no time did I ask you to use your influence as a congressman to effect my brother’s custody order in any manner. Now, that would certainly be in violation of the separation of powers as constitutionally defined. What I did ask you to do was use your position as a defender of the United States Constitution to simply suggest that the United States Department of Justice initiate an investigation of this corrupt judge and the widespread public corruption that is ongoing in the Blair County Court system. An investigation of this nature would certainly be in the best interest of thousands of fathers, mothers and children who have suffered similar judicial abuse by Jolene Kopriva and Hiram Carpenter for the last two decades. I am sure you have received numerous letters from other victims sharing the same concerns. Your letter has further suggested that the corruption that I speak of would be better addressed by the Pennsylvania Judicial Conduct Board . Apparently you haven ’t heard that the entire JCB is up for Impeachment before the State House of Representatives for covering up the crimes of an errant Lehigh County judge. For your information this judge was also nailed for altering transcripts and audio tapes of JUDICIAL proceedings. I guess this could be considered corruption running amok. And just possibly any DOJ investigation of the court system would likely spill over to the JCB as well. An action of this nature is long overdue and perhaps we can kill two birds with one stone. In the real world it is common knowledge among common folks that the judicial system can not police judges and lawyers no more effectively than congress can police congressman. This arrangement of self monitoring is all smoke and mirrors. It has never worked and it never will. In essence when one branch of government gets out of line it is up to the remaining two to straighten it out. The citizenry through its elected representatives have a right to demand and expect that our Constitutional rights and freedoms are protected and preserved. The best place to begin is right here on American soil, not in some Middle Eastern country which happens to have oil. However, your response letter reflects a total indifference to the civil and human rights violations against my brother and niece. It seems implementing the constitutional separation of powers is misused wholesale by politicians as a convenience for not getting involved with matters that could negatively effect their own political ambitions or bring disgrace and jail time to political acquaintances from the local country clubs. Fortunately, as an American citizen we still have the right to change the government through the voting process. Since you find the systematic brutalization of Stephanie Kearns (my niece) of no human or political interest to you, perhaps my family and I can be instrumental in separating you from power at the next election. In doing so, I will begin my efforts by bringing this corruption issue to Michael Delgrosso’s attention and assist him in any manner that will be instrumental in having you unseated as a congressman. If that isn’t enough to get the job done then we will consider regular protests in front of your office. As far as your brush off letter goes we have endured and tolerated these kind of categorized form letters from Bud Shuster for the last thirty years. Isn’t it time to break the family tradition? Separation of powers does not justify suborning crimes and political corruption. Then again after learning of your escapades of spying on your political opponent I understand more clearly why you refuse to delve into other areas of unethical behavior. Once again, I and my family are asking you to request the Department of Justice to investigate the Blair County Court for public corruption. These issues I mentioned are real and are just as destructive to human life and American freedoms as any act of terrorism abroad. For a change please use the Shuster name to secure fairness and justice in Pennsylvania and not some meaningless legacy posted on a highway sign. Sincerely, David Kearns |
